The Roanoke Times reported that Walthall was ordered to serve the sentence in Stafford County Circuit Court.

On July 15, 2019, the prosecutors said that Walthall called 911 to report that her boyfriend, Brandon Dye was unresponsive.

According to the Roanoke Times, Dye was immediately brought to Mary Washington Hospital, where he died from a heroin overdose.

Police officers recovered drugs, paraphernalia, and a video from the Stafford home.

The prosecutors said that the recovered video was recorded by Walthall as her boyfriend was dying from a substance overdose.

In the footage, Walthall could be seen laughing as she sexually abused Dye, and waited at least 45 minutes before calling 911 for help, the news outlet reported.

Walthall’s attorney argued that his client —who was also high on drugs at the time— made the tape to show Dye later, in order to get him to quit using the substances.

“It was done stupidly and wrongly, but there was no malice,” Attorney Price Koch said.

However, prosecutor Sandra Park rejected that argument, saying the delay in calling for help was inexcusable.

Walthall previously pleaded guilty to abusing an incapacitated adult, sexual battery, and two counts of possessing illegal drugs.

Authorities said that the second drug charge stemmed from an incident in which she gave a man drugs that caused him to overdose on at a motel in Stafford in December 2019.
